General terms and conditions of business

  1. scope

The General Terms and Conditions (hereinafter referred to as “GTC”) apply to all orders placed and contracts concluded (hereinafter referred to as “order”) via the CarEssenz online shop.

Car Essenz reserves the right to change the General Terms and Conditions. The version of the General Terms and Conditions valid at the time of the order is decisive and cannot be changed unilaterally for this order.

  1. Offer

The offer is aimed at natural customers residing or legal customers based in Switzerland.

The offer is valid as long as it is visible in the online shop and/or stocks last. Price and product range changes are possible at any time. The images shown in the online shop and all information about the products are for illustration purposes and are non-binding.

  1. Price

Prices are in Swiss francs, excluding value added tax (VAT). The price in the online shop at the time of ordering is decisive.

  1. Order

The presentation of the products in the online shop is not a legally binding offer, but a non-binding online catalog or a non-binding invitation to the customer to order the product in the online shop.

An order is considered an offer to Car Essenz to conclude a contract.

After submitting the order, the customer automatically receives a confirmation of receipt, which documents that the order has been received by Car Essenz.

Car Essenz is free to reject orders in whole or in part without stating reasons. In this case, the customer will be informed and any payments already made will be refunded. Further claims are excluded, in particular, products that cannot be delivered will not be re-sent. Products that are temporarily unavailable cannot be reserved.

  1. payment options

Payments must be made in Swiss francs.

PayPal, credit cards and debit cards are accepted as payment methods. The available payment methods are displayed in the online shop.

The debit will be made immediately.

Purchase on account is not possible.

  1. conclusion of the contract

A contract is only concluded when the order is processed in the Car Essenz logistics center. As soon as the order is ready for shipping, the customer receives an order confirmation by email.

  1. Delivery

No deliveries are made on weekends and official national or cantonal holidays.

If the customer is not present at the time of delivery and has not given any special delivery instructions, the delivery person will leave a collection invitation in the mailbox. The customer must then collect the delivery from the relevant post office.
Any order not collected within the specified timeframes cannot be kept or refunded. The customer is solely responsible for orders collected late and any claims for defects are excluded.

Any liability for damages incurred by the customer as a result of loss, theft, misuse, etc. in connection with the collection process or the collection slip is expressly excluded.

The customer assumes responsibility for the products delivered, even if they have not received them directly.

  1. delivery costs

The delivery costs depend on the quantity of products ordered. The delivery costs communicated in the online shop apply. The delivery costs are listed as an additional item in the shopping cart and on the invoice.

  1. warranty

Car Essenz can provide the warranty either by partial or complete replacement with an equivalent product.

  1. returns

The buyer bears the costs for returns. Returns must be agreed in advance with Car Essenz info@caressenz.com .

  1. notice of defects

If products are delivered with obvious damage to the packaging or contents, the customer must immediately complain to the delivery person and refuse to accept the goods, without prejudice to their rights in the event of defects. The customer is obliged to obtain a damage confirmation from the delivery person. All transport damage must also be reported to Car Essenz immediately.

Furthermore, it is the customer's responsibility to check the ordered products immediately upon receipt. In the event of any defects or deviations from the order, Car Essenz customer service must be notified on the day of delivery by email to info@caressenz.com . Car Essenz reserves the right to request proof of the defect.

  1. transfer of risk

The risk is transferred to the buyer as soon as the shipment has been handed over to the person carrying out the transport. If the shipment is delayed or becomes impossible through no fault of our own, the risk is transferred to the buyer when we notify them that the shipment is ready for dispatch. If Car Essenz agrees to cover the transport costs in individual cases, this has no influence on the transfer of risk.

  1. limitation of liability

Claims for damages arising from impossibility of performance, breach of contract, negligence when concluding the contract and tortious acts are excluded against us and against our vicarious agents, unless there is intentional or grossly negligent action. Any liability is rejected for consequential damages resulting from the use of the products.

  1. Applicable court and place of jurisdiction

The legal relationship is subject to Swiss law.
